LIMITED WARRANTY AND TERMS

TERMS

Payable upon receipt. Invoices unpaid after 30 days from date of invoice will be subject to a monthly service charge of 1½%. Pursuant to the Federal Truth-In-Lending Act, this is an annual percentage rate of 18%.

LIMITED WARRANTY FOR LANDSCAPE PLANTING

The Siebenthaler Company agrees to replace once, any woody plant provided and planted by us, that fails to grow for two years from the date of planting, if proper care was given, and the invoice was paid in accordance with the terms. LIMITED WARRANTY FOR PICKED UP/DELIVERED MATERIAL

The Siebenthaler Company agrees to replace once, any woody plant provided by us, that fails to grow for one year from the date of delivery, if proper care was given, and the invoice was paid in accordance with the terms.  Requests for replacement(s) must be accompanied with sales receipt and proof of loss. See exclusions below.

WARRANTY EXCLUSIONS

Annuals, perennials, ornamental grasses, groundcovers, roses, grass seed/sod, raised container plantings, cemetery plantings, houseplants & live Christmas trees are excluded.

If plants are out of stock, a substitute of like value can be made. If you wish to replace your plant with a plant of higher dollar value, you may do so by paying for the difference between the original cost of the plant and the new plant, and any additional planting charges. Any plant originally purchased at a discount of 25% or more will be replaced with a plant of the same dollar value. All replacements will be made when it is horticulturally proper. Claims must be made promptly, and within the warranty period.

If plants leave a Siebenthaler property unprotected, i.e., without a tarp, burlap or other protective cover, our warranty will no longer apply.

The Siebenthaler Company is not responsible for plant material that has been damaged by vandalism, fire, removal, relocation, wildlife, theft, mechanical damage by other contractors, or other activities beyond our control. Plant losses due to abnormal weather conditions such as floods, excessive wind damage, severe freezing, drought or heavy rains are not the responsibility of The Siebenthaler Company.

There are no warranties that extend beyond this description.
